This website is operated by Nova Balance Products (“we”, “us”, “our”). These Terms and Conditions govern your access to novabalanceproducts.com, your purchase of any product offered here, and your enrolment in any recurring programme we make available.

By visiting this site or placing an order you accept these Terms. If you do not agree with them, please do not use the site or purchase from it. We may modify these Terms from time to time; the current version is always posted on this page with the date it was last updated.

1. Online store terms

You must be of legal age in your state or province of residence, and have the legal authority to enter into a contract, in order to purchase from this site. You may not use our products or this site for any unlawful or fraudulent purpose, and you may not interfere with the operation or security of the site. We may suspend or terminate access for any breach of these Terms.

2. General conditions

We reserve the right to refuse or cancel service or any order, including where we identify suspected fraud, an unauthorised transaction, a pricing or listing error, or abuse of a promotion. You may not reproduce, duplicate, copy, sell or exploit any portion of the site, its content or its images without our written permission.

3. Website information

Information on this site is provided for general purposes only. It may contain errors, omissions or content that is no longer current. Information displayed here is not a substitute for professional advice and should not be relied upon as the sole basis for making health, medical, financial or other decisions. We may update or change site content at any time without obligation to do so.

4. Prices, promotions and changes

Prices, packages, promotions and product availability are subject to change without notice. The price displayed at checkout governs your transaction, except in the case of an obvious pricing error. Different customers may be shown different promotional offers at different times.

5. Products and purchase options

Comfort Essentials packages are offered at $69.00, $129.00, $158.00, $199.00, $207.00 and $294.00. Flexibility Support sets are offered at $57.00, $99.00, $114.00, $129.00 and $198.00. Rest and Routine sets are offered at $57.00, $99.00, $129.00 and $174.00. The Routine Wellness Digital Guide is a digital download offered at $1.95.

Each package lists the items it contains on its product page, and that list is what ships. Every offer above is a one-time purchase unless it is expressly identified as recurring. The only recurring offer on this site is the Comfort Balance Monthly programme described in Section 6.

6. Comfort Balance Monthly and recurring billing

Comfort Balance Monthly is an optional recurring programme. You are never enrolled automatically and no recurring charge is created unless you affirmatively accept the enrolment offer. The recurring shipment is not sold on its own: it is offered only in a confirmation box shown after the Comfort Balance Monthly Starter is added to your bag, and it is never pre-selected.

Initial order. Comfort Balance Monthly Starter — 5 items — $49.00, charged once at the time of purchase. If you accept the enrolment offer, the first Comfort Balance Monthly Refill shipment ($97.00) is charged as part of that same order, together with the $9.95 shipping charge that applies to physical orders under $158.00.

Recurring charge. After the first shipment, $106.95 per month ($97.00 product price plus $9.95 shipping), plus any applicable sales tax. The first recurring charge is made 30 days after enrolment and repeats every 30 days until you cancel.

Cancellation. You may cancel at any time, with no cancellation fee, by emailing support@novabalanceproducts.com or calling (800) 707-9928. To stop the next charge, your cancellation request must be received at least 48 hours before your next scheduled billing date. Cancelling ends future shipments and charges; it does not automatically refund a shipment that has already been sent, which is instead handled under the Return and Refund Policy.

Changes. We will give you at least 10 days’ advance notice by email before increasing the recurring price or making a material substitution to the contents of a monthly shipment.

7. Shipping charges

Physical orders under $158.00 carry a $9.95 shipping charge. Physical orders of $158.00 or more receive free standard shipping. Digital products carry no shipping charge. Comfort Balance Monthly shipments are charged $9.95 shipping per shipment, as set out in Section 6. Delivery estimates are estimates only and are not guaranteed unless expressly stated in writing.

8. Billing and account information

You agree to provide complete and accurate purchase and account information, and to keep it current so that we can complete your order and contact you if needed. You authorise us to charge the payment method you provide for the amounts shown at checkout, including any recurring amounts you have accepted.

We may cancel orders that appear to be placed by the same person or household using the same payment method or identifying information where we suspect fraud or abuse of a promotion.

Charges from this site appear on your statement as NOVA BALANCE PRODUCTS followed by our support number, so the charge is identifiable at a glance.

9. Optional checkout products and services

We may offer optional add-ons during checkout, including the VIP Delivery Package at $14.95, which is a one-time charge unless expressly stated otherwise. Optional items are never pre-selected and are never charged without your affirmative selection.

10. Returns, refunds and exchanges

Returns, refunds, replacements, exchanges and order cancellations are governed by our Return and Refund Policy, which forms part of these Terms. Eligibility depends on the condition and type of the product, the date of purchase and the extent of use.

11. Third-party services and tools

We rely on third-party providers for payment processing, hosting, analytics, shipping and fraud prevention. We are not responsible for the independent acts, omissions, availability, policies or practices of unaffiliated third-party providers. Your use of a third-party service is at your own discretion and subject to that provider’s own terms.

12. Third-party links

Links to third-party sites are provided for convenience and do not imply endorsement. We are not responsible for the content, security or policies of any third-party site.

13. Comments, reviews and submissions

If you send us comments, reviews, suggestions or other material, you represent that you have the legal right to do so and that the material does not infringe anyone’s rights or contain unlawful content. You grant us permission to use, reproduce and publish reviews and comments in connection with our business and marketing, to the extent permitted by law.

14. Personal information

Personal information you submit through this site is processed in accordance with our Privacy Policy. Payment information is processed by independent payment providers and is not stored on our systems.

15. Errors and omissions

We reserve the right to correct errors or inaccuracies in product descriptions, pricing, promotions, availability and delivery estimates, and to cancel affected orders. Where an order is cancelled after you have been charged, we refund the amount charged to the original payment method.

16. Prohibited uses

In addition to other prohibitions set out in these Terms, you may not use this site or its content: for any unlawful purpose; to solicit others to perform unlawful acts; to violate any regulation, rule or law; to infringe our intellectual property or that of others; to harass, abuse, defame or discriminate; to submit false or misleading information; to upload or transmit viruses or malicious code; to collect or track the personal information of others; to scrape, spider or crawl the site; for any obscene or immoral purpose; to interfere with or circumvent the security features of the site; or to abuse promotions or discount codes. We may terminate your use of the site for breaching any of these prohibitions.

17. Wellness and recovery product disclaimer

Products sold on this site — including heated wraps, cooling gels, compression supports, reusable gel packs, massage tools, eye masks, wellness supplements and insulated tumblers — are general wellness products. They are not medical devices and are not intended to diagnose, treat, cure or prevent any disease or medical condition.

Stop using any product if it causes pain, irritation or discomfort. Consult a qualified healthcare professional before use if you are pregnant or nursing, are recovering from an injury or surgery, have a circulatory or nerve condition, take prescription medication, or have any concern about whether a product is appropriate for you. Seek professional advice for pain that persists.

18. Disclaimer of warranties

Our website and services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law we disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the site will be uninterrupted, timely, secure or error-free.

19. Limitation of liability

To the maximum extent permitted by law, Nova Balance Products and its officers, employees, affiliates, agents and suppliers will not be liable for any indirect, incidental, special, exemplary, punitive or consequential damages arising from your use of this website or any product purchased through it. Some jurisdictions do not allow the exclusion or limitation of certain damages, in which case our liability is limited to the greatest extent permitted by law.

20. Indemnification

You agree to indemnify and hold harmless Nova Balance Products and its affiliates, officers, employees and suppliers from any claim or demand, including reasonable legal fees, made by a third party arising out of your breach of these Terms, your violation of any law, or your fraudulent or unlawful use of this site.

21. Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be enforced to the fullest extent permitted and the remaining provisions will continue in full force and effect.

22. Termination

You may stop using this site at any time. We may suspend or terminate your access where we identify fraud, misuse or a breach of these Terms. Cancellation of the Comfort Balance Monthly programme is governed separately by Section 6. Obligations incurred before termination survive it.

23. Entire agreement

These Terms, together with our Privacy Policy and Return and Refund Policy, constitute the entire agreement between you and us regarding your use of this site. Our failure to enforce any provision does not waive that provision.

24. Governing law

These Terms are governed by applicable federal law and the laws of the State of Wyoming, without regard to conflict-of-law principles, except where the consumer law of your own jurisdiction requires otherwise.

25. Changes to these terms

We may revise these Terms from time to time. The current version is posted on this page with the date it was last updated, and applies from the date it is posted. Material changes to a recurring programme receive the notice required by Section 6, and any increase in the recurring price receives at least 10 days’ advance notice by email.
